I understand that, although First Evolution Arts and its affiliates have made every reasonable effort to assure the safety of my child while participating in the activity, there are unavoidable  risks, and I hereby voluntarily agree individually, and on behalf of Daycare/School/Recreation Center, to indemnify, defend and hold harmless First Evolution Arts from any and all liability, loss, damage or expense, including attorneys’ fees, that they or any of their associates incur or sustain as a result of any claims, demands, actions, causes of action, damages, judgments, costs or expenses, including attorneys’ fees, which arise out of, occur during, or are in any way connected with my child’s participation in the Activity or any travel incident thereto.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. First Evolution Arts, LLC and her affiliates has put in place preventative measures to reduce the spread of COVID-19; however, the Business cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending First Evolution Arts, LLC and her affiliates could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending First Evolution Arts, LLC and her affiliates and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at First Evolution Arts, LLC and her affiliates may result from the actions, omissions, or negligence of myself and others, including, but not limited to, First Evolution Arts, LLC and her affiliates employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at First Evolution Arts, LLC and her affiliates or participation in First Evolution Arts, LLC and her affiliates programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless First Evolution Arts, LLC and her affiliates, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damage, costs or expenses of any kind arising out of or relating there to. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of First Evolution Arts, LLC and her affiliates, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Business program.

I have read, understood, and fully agree to abide by the above-stated policies set forth by First Evolution Arts and her affiliate and I register my child based upon these conditions. I recognize the risks of illness or injury by participating in a dance program and hereby waive, release and hold harmless First Evolution Arts staff and her affiliates from liability or claims resulting from participation in these program(s). I grant permission and release the use of image (photogenic or video) of the student(s) to be used by First Evolution Arts, LLC and her affiliates.
